“Chernetsova and others v. Russia

Dear Sir,

I write you pursuant to the information about the communication of the Nord Ost case.

On one hand I was happy to know from the media that the Court has communicated my complaint. On the other hand, I was bewildered and alarmed by the news. Together with Mr. Pavel Finogenov and other applicants represented by him, I lodged my complaint with the European Court on 26 April 2003.

However, Mr. Trunov whose legal position on the case I do not share filed another complaint much later, in December 2003, on my behalf without notifying me about it.

When I learnt about it from the Internet, I sent a letter to the European Court on 18 January 2004, by fax and by mail, where I stressed that my complaint was an inherent part of application # 18299/03 “Finogenov and others v. Russia”; I also informed Mr. Trunov about it. For some reason that I cannot understand, despite my letter I became one of the applicants on application # 27311/03 “Chernetsova and others v. Russia” who are represented by Mr. Trunov.

As I have never issued an authority to represent me before the European Court to Mr. Trunov, I insist that my representatives before the Court are Mr. Pavel Finogenov and lawyers Karinna Moskalenko and Olga Mikhaylova in application # 18299/03.

The legal position set forth in the above application corresponds in full to my assessment of the events; for this reason, I have originally authorised Mr. Pavel Finogenov and lawyers Karinna Moskalenko and Olga Mikhaylova to represent me before the Court.

Dear Mr. Nielsen,

To conclude my letter, I should draw your attention to the following.

As the Court has deemed it necessary to deal with the case relating to the tragic death of my family, I express my gratitude to the Court for its decision.

At the same time, I ask the Court to proceed with my complaint as a part of application # 18299/03 “Finogenov and others v. Russia” lodged on 26 April 2003 together with the families of the deceased Grigory Burban, Kristina Kurbatova and Igor Finogenov.

I kindly ask you to inform my representative Karinna Moskalenko about your decision.
